Judge Fines Trump For Violating Gag Order, Warns Of Future Jail Time

Judge Juan Merchan fined former President Donald Trump $9,000 Tuesday and held him in contempt for violating his gag order, warning he may impose jail time for future violations.

Merchan ordered Trump to remove the offending posts by 2:15 pm Tuesday and to pay the fine by May 3. He rejected Trump’s defense that he was simply engaging in political speech by responding to attacks by witnesses like Michael Cohen and Stormy Daniels, writing that the Court is “keenly aware of, and protective of, Defendant’s First Amendment rights, particularly given his candidacy for the office of President of the United States.” “It is critically important that Defendant’s legitimate free speech rights not be curtailed, that he be able to fully campaign for the office which he seeks and that he be able to respond and defend himself against political attacks,” Merchan wrote. “For that reason, this Court exercised discretion when it crafted the Expanded Order and delayed issuing it until the eve of trial.” However, Merchan warned Trump that he “will not tolerate continued willful violations of its lawful orders and that if necessary and appropriate under the circumstances, it will impose an incarceratory punishment.”

Prosecutors argued in court filings that Trump violated the order in 10 instances, arguing for the judge to impose the maximum $1,000 fine for each alleged violation. The gag order prevents Trump from making statements about witnesses, prosecutors other than the district attorney, court staff and jurors, along with family members of the staff, district attorney or judge.

Imagine the jail if the ‘judge’ placed Trump in custody.

1) The city has to empty the entire floor due to Trump’s secret service protection requirements. This wouldn’t be like placing me in jail with the general population.

2) Any appeal for the judge’s actions would accelerate to demonstrate his bias.

3) Finally, these idiots would have locked him into winning the election.

I’ve wondered all along if Trump it’s goading him into exactly that. The public response would be totally unpredictable to be sure, and I would bet highly favorable toward Trump.

The democrats in charge of Merchan will never take that chance.

He would put him under house arrest, so he could not even campaign on weekends. There is a reason they give the jury Wednesday instead of Friday off, cuts one extra day of campaigning and prohibits Orthodox Jews from participating as members of the jury because they would be late for Sabbath

I hope the corrupt judge does impose jail time on Trump - more proof of how utterly corrupt the system is when Trump’s detractors can exercise their “First Amendment Rights” and bash and debase Trump all over the media - but if he responds, he’s penalized.

Jailing Trump will only increase his chances to regain the presidency.

This “judge,” foreign born communist POS, doesn’t have the BALLS to toss Trump in Jail. If he did and was serious, this would have already happened. This judge is like a toddler, scream, stomp their feet, impose a fine on Trump, make threats, then slink off to a corner and suck their thumb!!!

This judge is just about as squishy as the president of Columbia University who set a 2pm deadline for the protestors (terrorists) to vacate and then at 2pm DID NOTHING.

This is all for show.

Who is going to make Trump pay? Who is going to lock Trump in jail?

President Trump should tell the judge to pound sand based upon his First Amendment rights under the U.S. Constitution.

If this state court judge orders an arrest, attorneys for Trump should immediately file an emergency order in U.S. District Court to demand immediate revocation of the unconstitutional order under the provision of the U.S. Constitution granting the President a right of petition for habeas corpus for unlawful arrest and imprisonment AND asserting his free speech rights as a citizen and leading candidate in this year’s presidential election.

Here is the Expanded Order

ORDERED, that the Court's Order of March 26,2024, is amended as indicated below. Defendant is directed to to refrain from:

a. Making or directing others to make public statements about known or reasonably foreseeable witnesses concerning their potential participation in the investigation or in this criminal proceeding;

b. Making or directing others to make public statements about (1) counsel in the case other than the District Attorney, (2) members of the Court's staff and the District Attorney's staff, or (3) the family members of any counsel, stafifmember, the Court or the District Attorney, if those statements are made with the intent to materially interfere with, or to cause others to materially interfere with, counsel's or staffs work in this criminal case, or with the knowledge that such interference is likely to result; and

c. Making or directing others to make public statements about any prospective juror or any juror in this criminal proceeding.
