Most autistic people tend to avoid conflict and are not violent. The claim of autism is to make him more of a sympathetic victim.

This is what happens when violent, disruptive kids are taught that whites have been “oppressing” them for 400 years and that it is permissible to attack any white for any reason.
He not only knocked her out cold on the first punch, he tried to murder her while she was defenseless. If a male teacher had not physically stopped him, he would have succeeded. I would up the charge to attempted murder.

A normal kid hits a teacher and he is expelled or suspended. A kid with an I.E.P. hits a teacher and there has to be a hearing with the likelihood of lawyers present before any discipline can be imposed. If the kid’s I.E.P. covers behavioral problems, the school might not be able to discipline him at all.
In addition the I.E.P. kid is guaranteed an education until his 22nd birthday and if necessary, education twelve months a year.
If I had to guess, the parents are receiving Social Security Supplemental income for the lad as well, since he is officially handicapped. Being put in prison may well end that income for them, so they are suing the district ‘for not meeting his needs’, which the law says they (but not the parents of normal kids) have the right to do.
In other words, HE is the victim. A well worn but trite defense.
Decisions made 400 years ago on this continent are coming back to haunt us in numerous, unpleasant ways.
My nephew has autism and is drummer in a world famous band where his therapy is playing (and being fawned over by the teenage girls). He’s happy go lucky but with strict, home schooling parents. My ex-boss’s kid, on the other hand, also has autism at the same age and all he does is play video games. He’s a spoiled little a-hole who triggers easily as his parents let him slide on everything. I know these are anecdotes and severities are aka “spectrum”, but I wonder if there’s a component to level of discipline?
Violent hulking autistic boys should be put down or incarcerated until they’re too old to hurt anyone.
The interior life of many special education kids is filled with anxiety and poor impulse control. And it seems that letting them destress in the classroom as they need actually improves their conduct. In effect, if a kid feels a need to use Nintendo or tear up sheets of paper into tiny bits or stare out the window, then let them. When they feel ready and able, they usually reengage with lessons.
