Court documents reveal an illegal Mexican immigrant charged with the murder of Ruby Garcia had several run-ins with police before he was deported in 2020.

Garcia's body was found on U.S. 131 Friday, according to Michigan State Police. Garcia was a Grand Rapids resident.

Brandon Ortiz-Vite, 25, was charged with the following Tuesday: felony murder, open murder, carjacking, carrying a concealed weapon, and felony firearm.

According to federal agencies, Ortiz-Vite reentered the country illegally at an unknown date and time.

If troopers identify an undocumented individual, they are required to inform Immigration Customs Enforcement, known as ICE.

ICE determines if these illegal immigrants can stay in the country, or at what point they are deported.

Court records reveal Garcia was in the car with Ortiz-Vite, when an argument took place, and she was shot multiple times.

Ortiz-Vite called Allegan County Central Dispatch Sunday to turn himself in.

Police say Ortiz-Vite was in possession of 9 mm pistol, and he told them he purchased the firearm illegally.

Court documents reveal he confessed to shooting Garcia, then dumping her body on the side of the highway and taking her car.

The car was found abandoned in South Haven with bullet holes and blood.

Ortiz-Vite has a criminal record that dates back to 2017 in Grand Rapids, when he was cited for driving without a license, or on a license that wasn’t valid.

Six months later, Ortiz-Vite was arrested and charged with illegal entry into a residence in Wyoming, court records show.

Ortiz-Vite remained in the country for three more years following the incidents.

Calhoun County Prosecutor David Gilbert says deportation is a lengthy process.

“I have dealt with cases before, where they are in the process of being deported, and you have other things that actually stand in the way of deportation,"

We’re able to see some——some-—of the illegal’s criminal exploits even though Michigan has recent laws to expunge the records. Plus several Michigan cities are sanctuary cities so cops aren’t allowed to inquire about the suspect’s background or genuine name.

From Michigan Legal Help website:
Expungement Can Be Done Automatically or with an Application
There are two separate adult expungement processes: You can apply for an expungement; or. Starting in April 2023, a conviction can be automatically expunged.

But “deported” is not like they are forever staring at the Wall and unable to come back. Many come back.

The murderer who got off for killing Kate Steinle on a pier in San Francisco “had been deported five times.”

He was an illegal alien from Mexico. He said he deliberately went to a sanctuary city when he came back. Although he was let off for the death the US said it would deport him again-—the 6th time.

RE: Plus several Michigan cities are sanctuary cities

I’m trying to understand this. Are you saying that Michigan is NOT a sanctuary state and cities in the state can decide whether they want to be sanctuary cities or not?

Is Michigan a sanctuary state? No, Michigan is not a sanctuary state, but it does have cities and several counties that are designated as sanctuary areas, according to the Center for Immigration Studies.
