Police serving order shot at, ATF says

A Pulaski County man fired several shots Tuesday at officers who attempted to serve a federal warrant at his mobile home at 3106 W. Justice Road in northern Pulaski County, a federal agent said.
No one was injured, and the resident, Johnny Davis, surrendered at about 2:30 p.m., roughly four hours after his standoff with officers began, said Joe Riehl, special agent in charge of the New Orleans Field Division for the Bureau of Alcohol, Tobacco, Firearms and Explosives.
Riehl said ATF agents obtained a warrant charging Davis with federal firearms violations and then, upon learning of potential problems they might encounter in serving the warrant, sought the help of the Arkansas State Police and the Pulaski County sheriffs office.
As the officers tried to serve the warrant, Davis refused to come outside, Riehl said. He said that over the course of about four hours, negotiators tried to talk to Davis, and officers deployed tear gas and used other tactics to make it uncomfortable for him to remain in the house.
Davis did fire some rounds at law enforcement officers, but none of the officers returned fire, Riehl said.
Riehl said Tuesday evening that officers were still processing the crime scene and he couldnt say how many shots had been fired or what caliber or type of gun was used to fire them.
Davis was taken before U.S. Magistrate Judge Tom Ray about 4 p.m. Tuesday to make his first appearance on a criminal complaint, which wasnt publicly available late in the day.
In court, however, the judge told Davis that because he had previously been found mentally incompetent by a court and had once been committed to the State Hospital, the judge had no choice but to grant a request for a mental evaluation from defense attorney Patrick Benca.
Benca, appearing at the hastily called hearing in casual clothes, made the request over Davis objections.
From a courtroom lectern, Davis told the judge, I would not like to go for a mental evaluation. He listed his constitutional rights, including his Second Amendment right to own a gun and his Eighth Amendment right not be tortured, among others.
I also know a lot about Arkansas criminal laws, and Im not mentally ill, Davis said.
He nodded his head in agreement after Ray explained why he was granting Bencas motion and placing Davis in the custody of federal marshals until a mental evaluation is complete.
The negotiators with the ATF and the Arkansas State Police did an excellent job, Riehl said later. Noting the presence of officers from those agencies and the U.S. Secret Service, he said, It was certainly a team effort.
I trust ATF as far as I could throw them nowadays. Wierd how they aren't saying much about this. I bet this guy filled out his 4473 wrong and got a SWAT team visit because he told some busy-body to shove it when they asked why he bought 3 handguns in 1 day, or why he abbreviated "ST" instead of Street or some other insipid, technical "violation".

So he didn’t break any laws (?) and the ATF decided because he used ST instead of STREET he was a THREAT?

Well, they were serving an unlawful warrant, since the feds don’t have any authority to infringe on our right to bear arms in the first place. No sympathy for them if they get shot at in that case.
Does anyone know the nature of the alleged “federal firearms violations”?
I don’t trust the ATF either.
I wondered why the sales clerk was so ADAMANT about “not abbreviating” when I filled out my last yellow sheet.
The only reason these thugs would be THAT picky about paperwork would be that they are LOOKING for an excuse.

ATF in LR has a very, very shady reputation. Ask Little Rock Police Dept. SWAT....they hate working with ATF.
I simply don't trust ATF, esp. here in Little Rock. I had a friend who was threatened with arrest because he said that he would like his stolen firearms returned (even though he got an insurance check). ATF tried to arrest him for insurance fraud on the spot...even though the insurance agent said....it wasn't fraud....
and even if this is a legit arrest, ATF warrants VERY CLOSE scrutiny!
Damn I would not trust the bastards as far as my neighbors two month old grand daughter could throw them.
Just the beginning. They’re coming for the guns! The question is will we stand up against it? Only if they try to come after us all at once. And they don’t have the man power for that.
That is WAY too vague. What were the actual charges and probable cause that led to the warrant?
NO. No one publicly knows the details of the warrant or arrest. The guy could be a nutcase, but as with all ATF actions....(check your history)...I suspect them of more criminal violations than almost any defendent I read about getting arrested (until the facts come out of course).
Hell, according to ATF, I'm a nutcase because I am suspect of all of F-Troops antics.

He can't buy a firearm from a Dealer (4473) if that was the case.
With the right trumped up charges, and a anti-gun prosecutors, anyone can be sent to the State Hospital (they have the largest holding tank for drunks BTW when the jails are full) for an "evaluation". Doesn't mean that he is really, medically, insane. If one of us were "sent" to the hospital against our will, we would be bouncing around a room screaming "I want a lawyer", "I'm not crazy", "I want out", "this is an outrage!", "I know my rights!", "You can't do this to me!", etc......easy for a liberal, anti-gun, psychiatrist/psychologist to deem you "mentally incompetent".....just sayin'
